Diversion Programs in Utah County, UT

Utah County Alternative Probation

The alternative probation program of Utah County is a public safety and anti-recidivism program that utilises in-community supervention via the “Sanctions Model.” The model provides a way to measure the appropriate level of supervision and proportional response to participant behavior by categorizing the offender into one of three risk assessment categories: low, moderate or high.

Low risk participants may require a very limited response for law enforcement to accomplish the goals of the alternative probation program, while high risk participants may require a great deal of both supervision and legal encouragement. Participation in the program is conditional, and certain activities can result a movement from low to high risk, or disbarment from the program altogether. Actions such as failing to pay fees or to comply with curfew or monitoring may result in an increased rating while criminal conduct or skipping town to avoid jail can result in removal from the program.

Participation in the model is conditional upon referral from local law enforcement.

Utah County Drug Court

The Utah County Drug Court is an alternative to incarceration, and has been in effect since 1998. In order to be admitted to the drug court, the offender must:

  1. Have a drug related felony charge or be on felony probation for a drug related charge.
  2. Be a Utah County resident.
  3. Have no history of violent offenses.
  4. Have no more than $1000.00 owing in restitution and must pay off restitution during drug court.
  5. Have no charges relating to drug distribution.
  6. Have not been to prison previously.

Additionally, if the offender committed a crime that resulted in a victim, the victim must also agree to allow the offender to enter the drug court. The court usually lasts between 6 to 12 months, but may be extended to 18 months.
