Habitual Sex Offender Definition
Utah Code §76-3-407: a person is considered a habitual sex offender if he or she was convicted of a prior sexual offense before the defendant was convicted of the sexual offense for which he or she being sentenced.
Prior sexual offenses include the following:
- Unlawful sexual activity with a minor;
- Rape;
- Sodomy;
- Forcible sexual abuse;
- Aggravated sexual assault;
- Custodial sexual misconduct;
- Felony offense of enticing a minor over the Internet; or
- Any similar sexual offense in another state or territory of the United States which, if committed in Utah, would constitute an offense described above.
Penalties for Additional Convictions as a Habitual Sex Offender
Utah code penalizes habitual sex offenders with an additional five years for each conviction of the defendant for a prior sexual offense which arose from a separate criminal episode. This is in addition to any other prison term served by the defendant.
Previous convictions can negatively affect any repeat offender and the subsequent sentencing they face. In many situations, individuals with prior convictions receive significantly more prison time.
