Revenge Porn Crime in Utah

According to Utah Code § 76-5b-203, an individual commits the offense of distribution of an intimate image if: 

  • They knowingly or intentionally distribute to a third party an intimate image of an individual who is 30 years old or older with the intent to case suffer emotional distress or harm.
  • They have not received consent from the individual depicted in the image to distribute the intimate image.
  • The intimate image was created by or provided to the alleged offender under has a reasonable expectation of privacy; and
  • Actual emotional distress or harm is caused to the victim as a result of the distribution.

The statute defines the term “distribute” as selling, exhibiting, displaying, wholesaling, retailing, providing, giving, granting admission to, providing access to, or otherwise transferring or presenting an image to another individual, with or without consideration.

Revenge Porn Penalties in Utah

In the state of Utah, revenge pornography is classified as class A misdemeanor. Class A misdemeanors are punishable by one year in jail and up to $2,500 in fines. A second or subsequent offense of electronic harassment is a third-degree felony. A third-degree felony, the least serious type of felony in Utah, is punishable by up to 5 five years in prison and up to $5,000 in fines.

Unlike some other states, Utah does not require an individual convicted of revenge porn or distributing an intimate image to register as a sex offender. The conviction will still appear on criminal records and can result in several collateral consequences.
