Object Rape Defined

Utah Code §76-5-402.2: Object rape occurs when absent the victim’s consent, a person causes penetration of the genital or anal opening of another person age 14 years or older by any foreign object, including a human body part other than the mouth or genitals, with intent to cause substantial emotional or bodily pain or with intent to arouse the sexual desire of any person.

Penalties for Object Rape 

A person convicted of object rape is guilty of a first-degree felony punishable by a minimum of five years to life in prison.

If during the commission of the crime, the defendant caused serious bodily injury to another, or if the defendant was younger than 30 years old, he or she may face 15 years to life in prison.

If at the time of the commission of the object rape, the defendant was previously convicted of a grievous sexual crime, he or she may also face 15 years to life in prison.

Some circumstances will allow a court to find a lesser sentence of six years to life or 10 years to life in prison, in the interests of justice.
